Terms and conditions

The terms for using Desktop Pals, PalPlayer, PalStudio and this website, in plain English.

These terms are between you and WhiteFish Creative Limited (“we”, “us”), a company registered in England and Wales with company number 11042372, at 3rd Floor, 86-90 Paul Street, London, EC2A 4NE. By downloading or using a Desktop Pal, PalPlayer, PalStudio or this website, you agree to them. Our privacy policy explains how we handle information about you.

Using the apps and pals

  • The official pals, PalPlayer and PalStudio Community are free for personal use. We give you a licence to install and use them; we keep the copyright and all other rights in them.
  • You may not sell them, copy them to sell, remove our names or notices, or reverse-engineer them except where the law allows you to.
  • The paid edition of PalStudio is covered by these terms and by the terms you accept when you buy it.

Where downloads come from

PalPlayer, PalStudio and the official pals must only be downloaded from the PalStudio website. You may not host, mirror or redistribute copies of their installers or files anywhere else, including on your own website, file-sharing sites or app stores. To point people to them, link to the website. Our brand page shows how, with badges you can use.

This keeps everyone safe: we publish fingerprints for each download and sign our updates, and a copy from somewhere else can’t be trusted in the same way.

Pals you make

  • Pals you make with PalStudio Community are yours. You may share them freely, but you may not sell them.
  • You are responsible for what you put in a pal and for having the right to use it: artwork, lines, sounds and names. Don’t include anything that is unlawful, hateful or infringes someone else’s rights.
  • A community pal must not suggest it was made or approved by WhiteFish Creative. It is “made with PalStudio”, never “by WhiteFish Creative”.
  • Don’t put personal information in a pal – not your full name, address, email address, phone number, or anything else that could identify you or another person. Everything in a pal is seen by everyone it is shared with. If you do include personal information, you are responsible for it, and we accept no responsibility or liability for it or for how anyone else uses it.
  • We don’t host, check or approve community pals, and we aren’t responsible for them. PalPlayer always labels them as community pals.

Our liability

The apps and pals are provided free and “as is”. We work hard to make them safe and reliable, but we don’t promise they will be free of faults or always available.

As far as the law allows, we are not liable for any loss of data, loss of profit or indirect loss arising from your use of the apps, the pals, community pals or this website. Where we are liable for something, our total liability is limited to the amount you paid us, if anything, in the 12 months before the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be limited by law. If you are a consumer, nothing here affects your statutory rights.

Changes and the law

We may update these terms. The current version will always be here, with its date at the top. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, though if you live elsewhere in the UK you may also bring a claim in your local courts.
